There are time limitations in which to notify property owners of accidents. Unless prompt notification is given, the homeowners' or other insurance companies may disclaim coverage, leaving the injured with no source of insurance coverage.
An area of insurance coverage that is often overlooked in premises liability cases is Medical Payments Coverage. This separate coverage, which is found in most premises insurance policies, will usually provide automatic, prompt payment of medical expenses without the need to show there was any fault or negligence by the insured. Unless a timely claim is made by the injured for this coverage, their own medical coverage may pay for hospital and doctors expenses; this can be a big mistake. Having the wrong insurance company pay your medical bills may end up costing you substantial amounts from an eventual lawsuit. Some insurance benefits for medical expenses have to be repaid out of a settlement or lawsuit recovery, and others do not.
